YourForms Do Not Call Policy

1. Purpose

This policy explains how YourForms honors Do‑Not‑Call (DNC) and marketing opt‑out requests for outbound calls and marketing SMS/MMS to U.S. consumers.

It is designed to support compliance with the Telephone Consumer Protection Act (TCPA, 47 U.S.C. § 227), the FTC Telemarketing Sales Rule (TSR, 16 C.F.R. Part 310), FCC telemarketing rules (47 C.F.R. § 64.1200), and applicable state “mini‑TCPA” and telemarketing statutes.

2. Scope

This policy applies to:

  • All outbound marketing calls.
  • All outbound marketing SMS/MMS messages.

made by YourForms and by any vendors acting on YourForms’ behalf (including Ringover, Twilio, HubSpot, and similar providers).

This policy does not limit purely transactional or legally required communications (for example, receipts, security alerts, or service notices). However, YourForms will still honor applicable legal opt‑out requirements.

3. Definitions

  • National DNC Registry: The FTC’s National Do‑Not‑Call Registry.
  • Internal DNC list: YourForms’ suppression list of numbers that must not receive marketing calls or marketing SMS/MMS.
  • Established Business Relationship (EBR): As defined by the TSR for purposes of National DNC Registry rules.
  • Opt‑out / revocation: Any reasonable request by a consumer to stop receiving marketing calls or marketing SMS/MMS.

Important: An EBR exception can be relevant to National DNC Registry restrictions under the TSR, but it does not replace any TCPA consent requirements that apply to the technology used (for example, prerecorded/artificial voice, automated dialing, or marketing texts).

4. National DNC Registry scrubbing

  1. Scrub timing. YourForms will scrub calling lists against the National DNC Registry before initiating a marketing calling campaign.
  2. Suppression. Numbers on the National DNC Registry will not be called unless an applicable legal exception applies (for example, TSR EBR where applicable) and TCPA consent requirements are met.
  3. Evidence. YourForms will retain scrub reports or vendor attestations as part of the records described in Section 9.

5. Internal DNC list (YourForms suppression list)

  1. How consumers can opt out. Consumers may request placement on the Internal DNC list by any reasonable means, including:
  2. Processing time. Opt‑out requests will be added to the Internal DNC list within 10 business days.
  3. Effect. Numbers on the Internal DNC list will not receive marketing calls or marketing SMS/MMS from YourForms or vendors acting on YourForms’ behalf.
  4. Retention. Internal DNC records will be retained for at least 5 years from the opt‑out date.

6. Opt‑out handling across channels

Unless a consumer clearly specifies otherwise, an opt‑out request will be treated as a request to stop all marketing outreach to that number.

Example: If a consumer replies STOP to an SMS, YourForms will suppress both marketing SMS/MMS and marketing calls to that number.

Channel‑specific opt‑outs may be honored when clearly requested (for example, “stop texts but calls are okay”).

7. Calling and messaging hours

YourForms will not place marketing calls or send marketing SMS/MMS outside the permitted hours, measured by the local time of the called party:

  • Federal (baseline): 8:00 a.m. – 9:00 p.m.
  • Texas: 9:00 a.m. – 9:00 p.m. Monday–Saturday; 12:00 p.m. – 9:00 p.m. Sunday
  • Other states: Where a state imposes stricter rules, YourForms will follow the stricter requirement.

8. State‑specific DNC registries

Where a state maintains its own DNC registry or list (for example, Illinois), YourForms will also scrub against that state registry when calling residents of that state.

9. Records and retention

YourForms will retain the following records for at least 5 years:

  • Opt‑out requests (including source/channel and processing date).
  • Internal DNC list history (or auditable change logs).
  • National and state DNC scrub evidence (scrub reports, vendor attestations).
  • Consent evidence where relied upon (for example, consent language and timestamp, webform logs, and TrustedForm certificates if used).
  • Vendor compliance evidence (for example, contract clauses, audit results, or periodic attestations).

Minimum fields for opt‑out records (recommended): phone number, opt‑out channel, request timestamp, processing timestamp, and any consumer instruction about channel scope.

10. Vendor requirements

All third‑party vendors placing calls or sending messages on behalf of YourForms must:

  • Comply with this policy and applicable federal and state law.
  • Use YourForms‑provided suppression lists (Internal DNC list) and apply them prior to outreach.
  • Provide scrub evidence and opt‑out processing logs upon request.
  • Notify YourForms promptly of any DNC‑related complaints or regulator inquiries.
  • Flow these obligations down to any subcontractors used for calling/messaging.

11. Changes to this policy

YourForms may update this policy from time to time to reflect changes in legal requirements, industry standards, or our practices.

How we will notify you. We will post the updated version on this page and update the “Effective date” at the top. Where required by law or where the change is material, we may provide additional notice (for example, by email or in‑app notice).

When changes apply. Unless stated otherwise, changes are effective as of the updated Effective date.

Prior versions. Upon request, we will provide prior versions of this policy for reference.
